Privacy Policy

1. GENERAL PROVISIONS
LIMITED LIABILITY COMPANY "GoGoBag", USREOU code 45674927, legal address: 6A, Larysa Rudenko Str., room 58, office 2, Kyiv, 02141, (hereinafter referred to as "GoGoBag", "we", "us", etc.), acts as the personal data controller and ensures the protection and respect for the confidentiality of your personal data. This policy (the "Privacy Policy") is designed to inform you about the collection, use, and dissemination of information you provide to us when you use the website https://gogobag.eu and/or the GoGoBag mobile application and/or the GoGoBag Telegram bot (the "Platform"). This Privacy Policy (together with the Terms of Use and any other documents to which they refer) sets out the basis on which we process any personal data we collect from you or that you provide to us. Please read the information below carefully to learn about our approaches and practices regarding your personal data and how we process it. The Privacy Policy is also a notice of the collection and processing of personal data. Having provided you with this notice, we will not additionally notify you of each fact of personal data processing, except in cases of determining a new purpose of processing. By registering on the Platform or logging in through "Facebook.com" or another social network, you give your full consent to GoGoBag's processing of your personal data in accordance with this Privacy Policy. By registering through social networks or accounts with third parties, you consent to the transfer or further processing and storage by GoGoBag of your personal data obtained from such accounts, as well as data that may be obtained additionally through the use of our Platform.
2. WHAT INFORMATION DO WE COLLECT FROM YOU?
We may collect and process the following data about you as a Member: By using our Platform, you may provide us with information, including personally identifiable information ("personal data"), by filling out a form on the Platform (such as a registration form), when you participate in our contests, marketing activities or surveys or by contacting us by phone, email or otherwise, or when you report problems with your use of our Platform. The information you provide to us may include: - Mandatory information required during registration to receive services through our Platform or other services we provide, including: your name, email address, date of birth and, when you create an account, a password. All of these fields are required. GoGoBag will not be able to provide you with services through the Platform if you do not provide such information or, if applicable, you will not be able to create a user account on our Platform; - Photo; - Mailing address; - Your phone number; - Details about your car; - Your mini-bio and your gender, if you agree to provide this information; - Record any correspondence between you and GoGoBag; we may record and/or listen to telephone conversations between you and GoGoBag (e.g., with agents of our Member Relations team). We give you the opportunity to object to such processing at the beginning of the conversation; - Recording any reservations you have made or travel-related offers you have posted on our Platform; - Details of accounting or financial transactions, including transactions carried out through our Platform or otherwise. This may include information such as payment card details or bank account details, in some cases it may be an individual tax number, details of travel or transportation that you have booked or offered through our Platform; - Details of your visits to the Platform and the resources you access; - If applicable, your responses to any surveys or questionnaires and your travel reviews that you have shared to evaluate the trip you have made using our Platform. Such information may be used for analytical purposes and to understand user interests; - Information that we may ask you to provide when you inform us about problems with our Platform or our resource, for example, information about the subject of your contact with the support service; - Data related to your location, if you have agreed that we collect and process this data, which allows us to respond to your search for rides near you; - A copy of your passport in the form of an ID card, passport for traveling abroad, driver's license and other similar documents proving your identity that you have agreed to provide to us, including upon our request; - We may ask you to undergo video verification only with your consent. We also collect information automatically: - If you choose to register using social media authentication methods, GoGoBag will have access to certain personal data (e.g., first name, last name, photo, and email address) in your social media account in accordance with the applicable terms of use of those social media. We may also collect some of your personal data when you use social media tools from third parties, such as "Like" functions. - With each visit to our Platform, we may, in accordance with applicable law and, where required, with your consent, collect information relating to the devices you use and the networks you connect to when you use our services. This may include information such as: your IP address, account login information, browser type and version, type and kind of browser plug-ins, operating system and platform, information about your visits to our Platform, including the URL clickstream to the various pages of our Platform, the content you viewed or searched for, search terms used, download errors, the length of time you visited certain pages, your device's advertising ID, page interactions, or any telephone number used to contact us. We collect this information through a variety of technologies. - We also collect aggregate information about your activities on our Platform (such as the number of trips you offer, the number, frequency and speed of your responses to messages, the date you registered, the average number of reviews you receive, etc.). Such information may be published on your public account on the Platform, if you have one.
3. FOR WHAT PURPOSE DO WE COLLECT INFORMATION FROM YOU?
We will use the information we collect to: 3.1. to fulfill our obligations arising from any agreements between you and us or you and our business partners, and to provide you with information and services, 3.2. to send you information about the services by e-mail and/or text messages and/or any other means of communication (for example, information about the confirmation of your reservation); 3.3. receive payments from you or transfer payments to you that we have collected on your behalf; 3.4. ensure the personalization of your user account on our Platform; 3.5. ensure your communication and interaction with other participants. 3.6. provide you with access to our support services and ensure that you communicate with our member relations team; 3.7. to improve the work of our member relations team and to train our customer service agents by recording your telephone conversations with us; 3.8. to ensure compliance with (i) applicable law, (ii) our Terms of Use, and (iii) the Privacy Policy. Certain violations that we deem unacceptable may result in the temporary suspension of access to your account, as set forth in the Terms of Use. For these purposes, we may use technology to automatically analyze your use of the Platform, including the content of your posts, in order to identify any actions that may constitute a violation on your part; 3.9. to send you, in accordance with applicable law and where required, with your consent, promotional materials and information relating to the provision of services or the reservation process, and to make offers and recommendations to you regarding products or services related to our services that may be of interest to you. We may also use your data to target you for the purpose of showing you our advertisements on social media platforms or third-party sites. You can learn more about how these features work and the data we collect from you by visiting the respective sections on the third-party social media platforms or websites; 3.10. inform you about changes in our services; 3.11. to verify the information contained in your account (phone number, email address), or in your passport, driver's license, identity card and other identification documents that may be received from you during registration or at any other time during your use of our Platform; 3.12. to administer the Platform and for internal activities, including for diagnostics, detection and elimination of deficiencies, data analysis, testing, as well as for research, analytical purposes and for conducting surveys; 3.13. improve our Platform to provide a way to display content that is most effective for you and your device; 3.14. to enable you to participate in interactive features of our service when you choose to do so, for example, to search for rides around you based on your location; 3.15. ensure, as part of our activities, the security and integrity of our Platform; 3.16. to measure or understand the effectiveness of the advertising we send to you and others, as well as to provide you with relevant advertising.
4. WHO IS THE RECIPIENT OF THE INFORMATION WE COLLECT FROM YOU AND FOR WHAT PURPOSE?
4.1 When you use our services, some information about you is shared with other members of our community or through your public profile. 4.2. We may receive and send information about you, including your personal data, if you use any other platforms we operate or to/from other GoGoBag entities or affiliates. 4.3. We also work closely with third parties who may be recipients of personal data, such as: - our business partners who are social media platforms and who may provide you with communication services, such as connecting the information in your GoGoBag account from their social media platforms to our Platform; - our business partners who may advertise their services on our Platform, to which you may subscribe and who may use your personal data only with your consent or other legal basis, - our business partners who may advertise our services on their websites; - our subcontractors and partners who provide technical services, non-cash payment processing and remote banking systems, verification of your identity documents, as well as user support, moderation and provision of analytical reports and solutions, etc. 4.4. We do not disclose the information you provide to us, including your personal data, to any third parties, except as provided in clause 4.3, as well as in the following cases: 4.4.1 If we decide to engage a third party service provider to fulfill any contract we enter into with you to facilitate or expand the scope of the services (for example, as part of payments made on our Platform). 4.4.2 As part of the reservation process, in order to provide you with the services you have requested, certain information, such as your name, photo, mobile phone number and/or e-mail address, may be displayed on the Platform and/or transmitted to another participant. 4.4.3. As part of our rating system, the reviews you write will be published on the Platform. The reviews, including your name abbreviation and photo, are visible to all visitors of the Platform. 4.4.4. We use analytical and search engine providers to improve and optimize our Platform. 4.4.5. If you explicitly request it (for example, when using social media authentication methods, subscribing to a service provided by one of our partners, requesting to participate in an offer or a favorable offer from one of our partners). 4.4.6. We may distribute portions of our Platform (including trips you have posted) for display on our business partners' websites through APIs or widgets. In such cases, some information from your public profile may be displayed on such websites. 4.4.7. We may share information for advertising or other business purposes consistent with this Privacy Policy. 4.4.8. GoGoBag may also disclose information if required to do so by law or in the good faith belief that such access, preservation or disclosure is reasonably necessary to (i) respond to complaints made against GoGoBag, (ii) comply with legal process, (iii) enforce any agreement with our users, such as our Terms of Use and Privacy Policy, (iv) in the event of an emergency, including a threat to public health, death or bodily injury to an individual, (v) as part of an investigation, or (vi) to protect the rights, property or personal safety of GoGoBag, its members, or others. 4.4.9. In the event of the sale or acquisition of any business or assets, we may disclose your personal data to a potential seller or buyer of such business or assets. 4.4.10. If a third party acquires GoGoBag or all or part of its assets, the personal data it holds about participants will be one of the transferred assets. 4.5. In accordance with applicable law and where required - with your consent - we may combine information about you, including your personal data and cookie information, and send and receive it from our business partners. We may use this information and the combined information for the purposes set out above. 4.6. We draw your attention to the fact that if you decide to provide us with information, including personal data, through the communication services of our partners, then in addition to this Privacy Policy, you may be subject to any privacy policy and/or notices of our business partners as well. We have no control over the collection and/or processing of your data that our business partners may perform on their platforms from time to time.
5. HOW DO WE USE AND MODERATE YOUR MESSAGES?
5.1. We may review, scan, or analyze the messages you exchange with other members of our community through our Platform to prevent fraud, improve our services, provide customer support, and enforce our agreements with our members (including the Terms of Service). For example, to prevent the circumvention of our online reservation system, we may scan and analyze messages sent through our Platform to ensure that they do not contain any contact information or links to other websites, and, where appropriate, this may result in blocking those messages or filtering all or part of those messages. 5.2. We never scan or analyze your communications with other community members for commercial or advertising purposes. Where possible, we may use automated methods to moderate such communications, but automated decision-making does not involve individual decision-making in this regard. 5.3 You hereby confirm your consent to access, monitor and otherwise use your communications on the terms and conditions described above.
6. TARGETED ADVERTISING ON SOCIAL MEDIA PLATFORMS AND OUR COMMUNICATIONS SENT VIA E-MAIL AND/OR OTHER TEXT MESSAGES
In accordance with applicable law and if required, with your consent, we may use the information you provide to us on our Platform for direct email marketing purposes, such as to (i) receive our newsletters, (ii) invite you to our events or other communications we believe may be of interest to you, or (iii) provide you with targeted advertising on social media platforms or third party websites based on your profile and your interests. Regarding electronic marketing communications: you can withdraw your consent at any time. Regarding targeted advertising and content: - on social media (e.g. Facebook and Twitter): you can object at any time by making your settings regarding advertising through your social media account or by contacting us as described in Section 14 below; - on third-party websites: you can read our Cookie Policy to learn about the objection procedure.
7. IS YOUR INFORMATION SHARED, HOW AND WHERE?
In general, we store the personal data we receive about you in the European Union (the "EU"). However, since, for example, some of our partners and service providers are based in countries outside the EU or the European Economic Area or in countries that are not signatories to the Council of Europe Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data ("third countries"), we also transfer some of your personal data to third countries. Such providers may be involved in, among other things, providing identity verification services, fulfilling your order for services, moderating your user account images, processing your payment information, providing advertising and marketing services on our behalf, and providing support services through electronic communications. This also applies to the transfer of personal data to GoGoBag affiliates located in third countries to whom we may share some of your user information to provide our services. We use Hetzner cloud servers, which provides a high level of physical and cyber security. Our servers are hosted in the European Union and comply with the General Data Protection Regulation (GDPR), ensuring that your service is compliant with European law. All connections between the customers (mobile app or gogobag.eu website) and the server are encrypted using the modern TLS standard. This protects data from interception during transmission. The data exchange between the application server and the database server is also protected, making it impossible to access information even within the internal network. Only authorized administrators have access to the servers. Authentication is performed via SSH keys, which is a more secure method than passwords. Access to data in the database is regulated at the role level. Users have access only to those functions that are authorized to them. We guarantee non-interference with your private and family life in connection with cross-border data transfers and ensure that such transfers are in accordance with applicable law and that appropriate safeguards have been taken to ensure that your privacy and fundamental rights are adequately protected. If you send a request to the email address provided in section 14 below, we can provide you with details regarding such cross-border data transfers.
8. WHAT RIGHTS DO YOU HAVE IN RELATION TO YOUR PERSONAL DATA?
8.1. You have the right to receive a copy of your personal data that we hold about you (your right to data access). 8.2. You can make a reasoned request to change or delete personal data if this data is processed unlawfully or is inaccurate (your right to erasure and correction). Please note that we may retain certain information about you as required by law or when we have a legitimate basis to do so. For example, if we believe you have committed fraud or violated our Terms and we want to prevent you from circumventing the rules applicable to our community. Unless otherwise required by law or this Policy, the retention period for information that includes your personal data may be ten years after (i) the date you closed access to your account or (ii) the date your account was blocked. 8.3. You have the right to submit a reasoned request at any time to object (i) to the processing of your personal data for direct marketing purposes or (ii) to other processing of your personal data in accordance with applicable law (your right to object to processing). 8.4. You also have the right to protect your personal data from unlawful processing and accidental loss, destruction, damage due to intentional concealment, failure to provide or untimely provision of personal data, as well as the right to protection against the provision of information that is false or discrediting your honor, dignity or business reputation. 8.5. You have the right to lodge a complaint with the relevant data protection supervisory authority or to seek legal remedies in court if you believe that your rights have been violated. 8.6. You have the right to request information about the conditions for granting access to personal data, in particular, the category of persons to whom your personal data has been transferred. 8.7. You have the right to receive information from us about the processing of your data in accordance with applicable law (including confirmation of processing, sources of collection, location of personal data, purpose of processing, location of the data controller) or to give an appropriate order to authorized persons to receive this information, except as otherwise provided by law. 8.8. You also have the right to withdraw your consent to the processing of your personal data by contacting us at the address specified in Section 14. If you withdraw your consent, the Platform and our services may not be available to you. Please note that we may continue to process your data if we have other legal grounds provided for by applicable law. Processing performed in accordance with the previously given consent shall remain in effect. 8.9. To exercise your rights, please contact us at the address specified in Section 14. The list of your rights set forth in this Privacy Policy regarding personal data is non-exhaustive and includes all rights provided for by the Law of Ukraine "On Personal Data Protection" and other applicable laws.
9. CHILDREN'S DATA
9.1. The Platform is intended for use by users over the age of 18 (eighteen), but in some cases, persons under the age of 18 (eighteen) may be senders or recipients of parcels, only with the consent and under the supervision of parents (one of the parents with whom such person lives or is his/her legal guardian) and in accordance with the norms and restrictions of the current legislation of Ukraine. Responsibility for compliance with the norms and restrictions of the current legislation of Ukraine regarding consent and supervision of any actions on the website or in the mobile application lies with the parents (one of the parents with whom such person lives or is his/her legal guardian) of a person under the age of 18 (eighteen).
10. RECIPIENTS' DATA
10.1. During the delivery of parcels, you may provide information about the recipients of parcels, so we may collect such data about the recipients to provide you with services: 10.1.1. Surname and name of the sender and recipient of the parcel, 10.1.2. Address of the delivery place, 10.1.3. Phone number, e-mail address and other information provided to us by the sender.
11. CONFIDENTIALITY OF YOUR PASSWORD
By choosing a password that allows you to access certain sections of the Platform, you are responsible for maintaining the confidentiality of such password. We urge you not to share your password anywhere.
12. LINKS AND REDIRECTS TO OTHER WEBSITES AND SOCIAL NETWORKS
Our Platform may from time to time contain links to/from the websites of our partner networks, Logistics Companies or their agents (if applicable), our advertisers and affiliates. If you follow a link to any of these websites, please note that such websites have their own privacy policies, and we do not assume any obligation or responsibility for these policies. Please review the policies posted on such websites before you submit any personal data to the respective websites.
13. CHANGES TO THE PRIVACY POLICY
Any changes we make to our Privacy Policy in the future will be posted on this page. We will notify you or seek your consent where appropriate. Please check this page from time to time to be informed of any additions or changes to this Privacy Policy.
